Terms of Service

1. Acceptance of Terms
Welcome to Opnerr ("Opnerr," "Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Opnerr platform. By creating an account, accessing, or using the Platform, you agree to be bound by these Terms.
2. Nature of the Platform
Opnerr is a technology marketplace facilitating connections between independent users for task-based services. Opnerr is not a real estate brokerage and does not supervise licensed activity, negotiate contracts, create agency relationships, or control property access.
3. Eligibility and Account Registration
Users must be at least 18 years old, provide accurate information, and maintain secure login credentials. Opnerr may suspend or terminate accounts at its discretion.
4. Licensing and Professional Compliance
For tasks requiring licensure, users must hold an active license in good standing in the relevant jurisdiction. Opnerr may verify licenses at onboarding but does not conduct ongoing monitoring. Users are solely responsible for maintaining compliance and notifying Opnerr of any licensing changes.
5. Independent Contractor Status
All users act as independent contractors. Nothing in these Terms creates employment, partnership, joint venture, or agency relationships.
6. Property Access
Opnerr does not grant or control property access. Requesting Users authorize property access at their own discretion and assume associated risks. Performing Users are responsible for damages or losses arising from property entry.
7. Task Agreements
When a task is accepted, a direct agreement forms between users. Compensation is negotiated solely between users. Opnerr does not set pricing.
8. Payments and Platform Fees
All payments must be processed through Opnerr via third-party processors such as Stripe. A 10% platform service fee is deducted prior to payout. Payments may be pre-authorized and automatically released after 48 hours if undisputed. Opnerr is not an escrow agent or fiduciary. For full details, see the Payment & Cancellation Policy.
9. Proof of Performance
Performing Users must upload reasonable documentation evidencing task completion. If no dispute is submitted within the review window, payment may be released. Falsified proof may result in termination.
10. Anti-Circumvention
All tasks and payments arising from introductions through Opnerr must remain on-platform for 12 months. Circumventing platform fees may result in suspension or recovery of unpaid fees.
11. Non-Solicitation
Performing Users may not solicit clients introduced through the Platform for 12 months following task completion.
12. Messaging and User Content
Users are responsible for communications through the Platform. Opnerr reserves the right to review or remove content and may use communications in dispute resolution.
13. Ratings and Reviews
Ratings are for internal use only. Opnerr may remove or disregard reviews at its discretion.
14. Assumption of Risk
Users acknowledge inherent risks in engaging other users. Opnerr does not guarantee safety, reliability, or performance.
15. Indemnification
Users agree to indemnify and hold Opnerr harmless from claims arising from task performance, licensing violations, property damage, or breach of these Terms.
16. Limitation of Liability
Opnerr shall not be liable for indirect or consequential damages. Total liability shall not exceed platform fees paid in the preceding 12 months.
17. Privacy
Use of the Platform is governed by the Opnerr Privacy Policy.
18. Termination
Opnerr may suspend or terminate accounts for violations, fraud, misconduct, or regulatory concerns.
19. Dispute Resolution; Binding Arbitration; Class Action Waiver
Disputes shall be resolved through binding arbitration administered by the American Arbitration Association in Harris County, Texas. Users waive jury trials and agree not to participate in class actions.
20. Governing Law
These Terms are governed by the laws of the State of Texas.
21. Modifications
Opnerr may update these Terms at any time. Continued use constitutes acceptance.
